A Federal court in Abuja, on Thursday, June 2, granted a request by Abba Kyari, the detained deputy commissioner of police, to file more evidence to challenge a suit by the Federal government seeking to extradite him to United States of America to face fraud charges.

The court granted the request of Kyari made through his lead counsel, Nureni Jimoh, SAN, in a motion on notice.

Jimoh, while arguing the motion on notice, asked the court to allow Kyari bring additional documentary exhibits to establish his innocence in the charges against him, according to reports.

Mr Pius Akuta, the Federal Government’s counsel, however, opposed the request.

Akuta predicated his opposition on the ground that it was an attempt to cure deficiencies in the earlier documentary evidence adduced by the detained police officer.

Justice Ekwo, in a brief ruling, however, rejected the Federal Government’s objection, and allowed Kyari to present further documentary exhibits to his own defence.

The court would have ample opportunity to evaluate the probate value to be attached to the additional evidence, according to the judge.

Meanwhile, Justice Ekwo has set June 3, 2022 as the date for a definite hearing in the extradition case brought against Kyari by the Attorney-General of the Federation on behalf of the Federal Government.

The suit seeks to extradite Kyari at the request of the American government to face trial in his indictment in an alleged internet fraud by Abdulrahman Abbas, commonly known as Hushpuppi.

Kyari’s extradition to the United States was sought by the Federal Government in order to have him answer questions about his suspected link the fraudster, Hushpuppi, according to reports.

The application was marked FHC/ABJ/CS/249/2022, and was filed by the Federal Government through the Office of the AGF.

The suit was filed on March 2, 2022, and was titled “Application for the Extradition of Abba Kyari to the United States.”
